Purpose:

~ Provide legal advice and counsel to various Hyundai business units as it relates to their interaction with HMA’s dealer network.

~ Provide support and guidance to members of the Hyundai business units in connection with rollout of programs or corporate initiatives. 

~ Handle and/or provide assistance in the management of dealer litigation and issues affecting the manufacturer/dealer relationship.

~ Manage the discovery processes for manufacturer/dealer litigation and provide counsel on legal issues affecting the manufacturer/dealer relationship.

~ Conduct legal research as needed. 

 

Major Responsibilities:

~ Render, on a timely basis, advice and counsel to the business units as it relates to general market representation issues affecting the manufacturer.

~ Provide training to the field in connection with the manufacturer’s sales evaluation program.

~ Work on the construction of various dealer-facing manufacturer initiatives introduced by the company from time to time.

~ Manage and assist with manufacturer/dealer litigation across the country.  This includes supervising the matter, formulating case strategies and tactics, marshaling the company resources for prosecution of the case, and handling discovery.

~ Oversee the franchise team’s discovery processes.

~ Prepare detailed responses to discovery requests including interrogatories, requests for production of documents and requests for admissions on behalf of Hyundai.

~ Coordinate the preparation of document productions in response to requests for production of documents and subpoenas.

~ Assist Internal Audit and Finance on legal issues relating to dealer incentive and warranty audit matters; manage related dealer disputes and litigation.

~ Maintain current knowledge of and provide regular updates to National Sales and the Regions on recent developments in state dealer franchise laws, federal regulations and case law.

~ Conduct, as needed, research into various state law franchise affairs.  Prepare memoranda regarding the same.

~ Provide counsel to National Sales and HMA’s Regions on legal issues affecting the manufacturer/dealer relationship, including interpretation of HMA’s dealer agreement, distribution, and incentive and pricing issues.

~ Draft and/or review documents relating to market representation actions and dealer transactions with HMA, including letters of intent, relocation commitment letters, default notices, termination notices, asset purchase agreements, dealer appointment notices to state agencies, dealer financial assistance requests and internal market studies.

~ Some travel required. 

 

Education:

~ Bachelor’s degree required.

~ Juris Doctorate required.

 

Related Experience:

~ Four or more years of experience in business litigation required; automotive franchise law or automotive franchise affairs experience highly preferred and suggested.

 

Skill / Knowledge:

~ Strong analytical skills, strong drafting and negotiation skills, strong oral and written communication skills.

~ A strong understanding of automotive dealer operations and networks.

~ Excellent people skills.

~ Team-oriented and willing to work collectively.

~ Strong work ethic essential. 

~ Self-motivated and innovative.

 

Certifcation Required:

~ Member California State Bar Association
